One of the Employment Rights Bill’s primary focuses is on zero-hour contracts, which currently don’t require employers to provide any minimum working hours, leaving workers with a lack of income security and stability. Under the new legislation, employers will be required to offer guaranteed hours to workers who meet certain criteria, though the details on eligibility are still being finalised. Importantly, this offer of guaranteed hours isn’t mandatory for workers to accept, as they will have the freedom to choose based on their preferences and needs.
Employers will also need to repeat these offers periodically, ensuring that workers regularly have the opportunity to secure guaranteed hours if their circumstances align with the outlined conditions. In addition, zero-hour contract workers will be entitled to reasonable notice of when they’ll be required to work and compensation if shifts are changed or cancelled at short notice.
However, what qualifies as “reasonable” or “short” notice is still unclear, with the bill suggesting that these periods will be specified in separate regulations.
A Notable Exclusion: Agency Workers
Interestingly, agency workers are currently excluded from the bill’s protections around predictable working patterns. This is a notable shift from the scrapped legislation that was originally set to take effect last month, which would have provided agency staff with similar protections. However, the Government is currently consulting on how the bill’s protections could be extended to agency workers and, if so, how such protections should look. Indeed the bill seeks to grant the Secretary of State the power to introduce similar rights for agency workers in the future.

For workers, these changes bring a glimmer of increased security and flexibility. For employers, it adds some complexity but ultimately could create a more predictable and stable workforce.
