Employment Newsletter: Edition 24

Our July employment law newsletter is out now, covering three issues that matter to employers right now: how to run a fair workplace investigation, how to handle grievances drafted with AI, and what a recent disability discrimination case means for how you use occupational health advice.

Conducting a fair investigation

With changes to unfair dismissal rights coming into effect from 1 January 2027, more employees will be able to bring a claim, so getting your investigation process right matters more than ever. We look at what tribunals expect from a fair, well-documented investigation, including who should investigate, how to approach witnesses, and the record-keeping that can make or break your position if a dismissal is later challenged.

Don’t let AI-generated grievances trip you up

Employees are increasingly using AI to draft grievances, and while these often look polished, they can be unfocused, padded with irrelevant detail, or built on inaccurate assumptions. We explain what to look out for and how to identify the real issue at the heart of the complaint, so you can investigate the right thing and avoid a costly breach of the ACAS Code.

Cunningham v BBC: when are you “on notice” of a disability?

This case looks at when an employer should reasonably have known an employee was disabled, even without an explicit diagnosis from occupational health. We break down what the Employment Appeal Tribunal decided and the practical lessons for any employer relying on occupational health reports to manage an employee’s health at work.
